These Terms of Service (the “Terms”) are an agreement between you and Lynup, operated by Brendon Baugh (“Lynup,” “we,” “us,” or “our”). They govern your access to lynup.xyz and Lynup’s creator submission, queue, payment, community, and related services (the “Service”).

By creating an account, using an account, submitting content, making a purchase, connecting a payout account, or otherwise using the Service, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the Service.

1. Eligibility and age

Accounts, purchases, and creator payout functionality are intended only for people who are 18 years of age or older. You must truthfully attest that you are at least 18 before using those features. Lynup does not currently collect a date of birth as part of this attestation.

You may use the Service only where doing so is lawful. If you use Lynup on behalf of a business or other organization, you represent that you have authority to bind it to these Terms.

2. Accounts and security

You must provide accurate information, keep account credentials secure, and promptly update information that becomes inaccurate. You are responsible for activity performed through your account unless applicable law provides otherwise.

Do not access another person’s account without authorization or bypass authentication, moderation, payment, rate-limit, or security controls. If you believe an account has been compromised, revoke unfamiliar sessions and contact support@lynup.xyz.

Lynup supports email/password accounts and, when configured, Twitch and Discord sign-in or account connections. Your use of those providers remains subject to their own terms and privacy practices.

3. The Lynup Service

Lynup is a creator submission and queue platform. People may submit music, videos, clips, websites, profiles, creative work, brands or products, links, and supported media. Creators may operate free queues, offer paid priority, receive voluntary support, run Head-to-Head features, and use supported Twitch, Vault, chat, overlay, moderation, analytics, and integration tools.

Creators control their queues. A creator may open, pause, end, reorder where the product permits, play, stop, skip, reject, block, or remove submissions and may establish additional stream-specific rules. Creator rules cannot override applicable law, these Terms, Lynup policies, copyright requirements, payment-provider restrictions, or Lynup’s refund and enforcement authority.

Lynup may add, change, suspend, or discontinue features. We will make reasonable efforts to avoid disrupting paid functionality, but the Service may experience errors, maintenance, provider failures, or interruptions.

4. Paid priority, support, and credits

Skip, Super Skip, and paid boosts purchase queue-priority mechanics. They do not purchase or guarantee playback, a minimum listening or viewing duration, a reaction, a review, positive feedback, promotion, endorsement, audience exposure, followers, streams, sales, creator approval, or business results.

Direct creator support is voluntary support. It does not buy a review, reaction, promotion, priority, endorsement, or guaranteed creator service. Vault or Twitch-related credits are product features, are not money or stored value, and have no guaranteed cash value unless Lynup expressly states otherwise.

Purchases are also governed by the Submission & Refund Terms. The price, currency, and applicable product are displayed before checkout. Stripe processes card payments; Lynup does not locally collect raw card numbers or CVC data through the current checkout implementation.

5. Your content and permissions

You retain ownership of content you submit. You represent that you have the rights, licenses, consents, and permissions needed to submit it and allow Lynup to operate the Service as described here.

You grant Lynup a limited, non-exclusive, worldwide license to host, store, process, transcode where necessary, display, play or embed, transmit to the creators and moderators you select, operate overlays and integrations, secure and moderate the Service, and otherwise use the content only as reasonably necessary to provide normal Lynup functionality. This license lasts while the content is used or retained for those purposes and for a reasonable period needed for backups, disputes, security, legal obligations, or enforcement.

This operational license does not give Lynup a broad perpetual right to use your content in unrelated advertising. Marketing or promotional reuse outside ordinary operation of Lynup requires separate permission where appropriate.

Removing an item from a queue may change its status without immediately deleting all metadata, provider copies, backups, public results, recaps, moderation evidence, or copies made by creators, livestream platforms, or other third parties.

6. Third-party services and content

Lynup works with services such as Stripe, Twitch, Discord, Spotify, YouTube, SoundCloud, Google Analytics, Resend, browser push services, and user-selected websites or media hosts. Those services are independently operated, may change or become unavailable, and apply their own terms and privacy policies.

Accepting or displaying a third-party URL does not mean Lynup controls or endorses the destination, verifies its safety or accuracy, or owns the linked content. You are responsible for deciding whether to visit or rely on third-party content.

7. Acceptable use

You must comply with the Acceptable Use & Community Guidelines. You may not use Lynup for illegal activity, infringement, fraud, payment abuse, prohibited sexual content, harassment, threats, hateful abuse, scams, malware, spam, impersonation, queue manipulation, unauthorized access, misuse of personal information, or activities prohibited by Stripe or another applicable provider.

Lynup does not promise to detect every violation before content appears. Creators, moderators, providers, and Lynup may investigate or act on content and conduct after it is submitted or displayed.

8. Suspension, removal, and termination

Lynup may remove content or restrict, suspend, or terminate accounts or features for policy violations, fraud, payment abuse, security risks, infringement, illegal activity, abusive conduct, repeated violations, attacks on Lynup, provider restrictions, or serious misuse. We may preserve records and cooperate with providers or lawful requests where appropriate.

You may contact support@lynup.xyz if you believe enforcement was mistaken. This contact option does not create a formal appeal procedure or require Lynup to restore content or access.

Suspension or termination does not automatically erase payment obligations, disputes, chargebacks, refund reviews, copyright cases, or records reasonably needed for security, fraud prevention, enforcement, or law.

9. Account deletion and retention

A signed-in user may submit an account deletion request from account settings. Requests are reviewed rather than treated as an immediate deletion of every record.

Lynup may retain records reasonably necessary for transactions, refunds, disputes, chargebacks, security, fraud and abuse prevention, legal obligations, copyright cases, enforcement of agreements, and backups. Public or third-party copies may remain outside Lynup’s control. The Privacy Policy explains the implemented upload-file retention process and other retention limits.

10. Lynup intellectual property

The Service, including Lynup software, interfaces, branding, and original materials, is owned by Lynup or its licensors and protected by applicable law. These Terms permit you to use the Service; they do not transfer ownership of Lynup technology or branding.

Feedback may be used to improve Lynup without an obligation to compensate you, but this does not transfer ownership of your separately submitted creative content.

11. Disclaimers and responsibility

The Service is provided on an “as available” basis. To the maximum extent permitted by applicable law, Lynup disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted operation, permanent availability of third-party content, or any creator response or outcome.

You remain responsible for your content, conduct, transactions, links, and compliance with law. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.

12. Limitation of liability

To the maximum extent permitted by applicable law, Lynup will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, audience, or opportunities arising from use of the Service, third-party content, creator decisions, or provider failures.

Where liability cannot be excluded, Lynup’s responsibility is limited to losses that are a reasonably foreseeable result of its breach. These limitations do not exclude liability that applicable law does not allow Lynup to exclude or limit.

13. Responsibility for claims

To the extent permitted by law, you agree to defend and indemnify Lynup from third-party claims, damages, and reasonable costs arising from your content, your unlawful or unauthorized conduct, or your material violation of these Terms. This obligation does not apply to the extent a claim was caused by Lynup’s own unlawful conduct.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. This clause does not deprive you of mandatory protections that apply under the law of your place of residence.

These Terms do not require arbitration and do not contain a jury-trial waiver, class-action waiver, or exclusive county or court venue clause.

15. Policy changes and contact

Lynup may update these Terms as the Service changes. Each published version has a version number and effective date. Material changes will apply prospectively where appropriate, and Lynup may require fresh acceptance. Historical acceptance records are not rewritten when a new version is published.
